1. User Responsibilities

1.1. Eligibility: You must be at least 18 years of age or the age of majority in your jurisdiction to use Freelance Fusion. By using our platform, you represent and warrant that you meet these eligibility requirements.

1.2. Account Registration: To access certain features of Freelance Fusion, users must register for an account. During the registration process, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.


1.3. User Conduct: All users agree to act professionally and responsibly in their interactions on Freelance Fusion. This includes maintaining respectful communication, adhering to all project agreements, and complying with applicable laws and regulations. Users must not engage in any conduct that is harmful, fraudulent, or illegal.You agree to use freelancefusion.club only for lawful purposes and not to engage in any activities that may violate applicable laws or regulations.

1.4. Platform Intent: The platform is intended for freelancers and clients to connect, collaborate, and execute projects. Users must register for an account and agree to provide accurate, current, and complete information.

1.5. Right to Refuse Service: Freelance Fusion reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.

2. User Accounts


2.1. You are responsible for maintaining the security of your account login information.
2.2. You must not share your account credentials with anyone else.
2.3. You are responsible for all activities that occur under your account.


3. Services Offered


3.1. Service Providers:

Freelancefusion.club acts as a platform to connect individuals and businesses ("Freelancers") with service providers ("Service Providers") offering professional services. We do not provide the services directly. Service Providers are independent contractors and not employees or agents of Freelancefusion.club.


3.2. For Freelancers:

Freelance Fusion provides a platform to showcase your skills, connect with potential employers, and engage in projects across various industries. Freelancers are responsible for delivering quality work by the project terms set forth by employers.

3.3. For Clients:

Employers can post projects, outlining their requirements and budget. Employers are responsible for selecting the right freelancer for their project and for providing clear, accurate project details.

3.4. Service Availability:

We strive to ensure that our Service is available at all times, but we do not guarantee uninterrupted or error-free operation. We may suspend or restrict access to the Service to perform maintenance or updates.


4. Payments

4.1. Payments for services are processed through our secure payment gateway.

4.2.Upon the successful completion of a task or project, as defined by the agreement between the freelancer and the employer, the total payment received will be distributed as follows:
Fifty percent (50%) of the total project fee will be credited to the freelancer as their earnings.
Fifty percent (50%) of the total project fee will be retained by freelancefusion.club as the platform's service fee.
4.3. Freelancers may set their rates, and clients agree to pay the agreed-upon amount for services rendered.
4.4. All payments are subject to a service fee, the details of which can be found on our website.

5. Additional Benefits for Freelancers 

5.1. Subscription Benefits
Freelancefusion.club offers its registered freelancers the unique advantage of accessing various third-party service subscriptions ("Subscriptions"). These Subscriptions are intended to aid in the facilitation of freelance work and enhance overall productivity.
5.2. List of Subscriptions
The Subscriptions provided may include but are not limited to, services such as Zoom, Miro, Google One, Notion, YouTube, ChatGPT, Netflix, Midjourney, Canva, Wordwall, ESL Brains, Freepik, Patreon, Sendpulse, Adobe, Idroo, Quizlet, Wix, Digital Ocean, TickTick, Vultr, Google Workspace, Vimeo, Zoomba, Baamboozle, Mindmaster, LinkedIn, Loom, Envato Elements, Asana, Beatstars, JetBrains, Language House, Dropbox, Preply, MyHeritage, Microsoft Office 360, and others as periodically updated and communicated by Freelancefusion.club.
5.3. Terms of Use
Access to and use of these Subscriptions are subject to the terms and conditions set by their respective providers. Freelancers are responsible for adhering to these terms.
These Subscriptions are provided at no additional cost to freelancers who are actively engaged and in good standing on the Freelancefusion.club.platform.

6. Project Management
 
6.1. Proposals and Acceptance:
Freelancers can submit proposals for projects, and employers are free to accept proposals based on their assessment of the freelancer's suitability for the project.

6.2. Completion and Payment:
Projects are considered complete when the employer approves the work submitted by the freelancer. Payment terms, including milestones and final payment, should be agreed upon before the commencement of work.

6.3. Dispute Resolution:
In the event of a dispute, Freelance Fusion offers a mediation service to help resolve issues between freelancers and employers. Both parties are encouraged to communicate directly to resolve issues before seeking mediation.

7. Intellectual Property

7.1. Ownership:
Upon full payment, the intellectual property rights of the work produced by a freelancer for a project transfer from the freelancer to the employer, unless otherwise agreed upon.

7.2. Licensing:
Freelancers may retain ownership of their work but grant employers a license to use that work, as detailed in the project agreement. Specific terms regarding intellectual property rights should be clearly outlined in the project agreement.

7.3. Protection of Intellectual Property:
Both freelancers and clients are expected to respect each other's intellectual property rights. Any unauthorized use of another's intellectual property is strictly prohibited and may result in account suspension or termination.

8. Confidentiality

8.1. Confidential Information:
Both parties agree to keep all sensitive and confidential information disclosed during the project confidential. This includes project details, proprietary methods, business strategies, and any other information that is not publicly available.

8.2. Definition of Confidential Information:
Confidential information includes, but is not limited to, any information that is marked as confidential, or that a reasonable person would understand to be confidential given the nature of the information or the circumstances of disclosure.

8.3. Exceptions to Confidentiality:

Confidentiality obligations do not apply to information that:
Was known to the receiving party before disclosure without an obligation of confidentiality.
Becomes publicly available through no fault of the receiving party.
Is independently developed by the receiving party without the use of or reference to the disclosing party's confidential information.
Is disclosed to comply with a legal obligation or court order, provided that the receiving party gives the disclosing party prompt notice of such requirement and cooperates with any attempts to limit the scope of the required disclosure.

9. Limitations of Liability

9.1. Disclaimer of Warranties:
Freelance Fusion is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our Service or the information, content, materials, or products included on the platform.

9.2. Limitation of Liability:
Freelance Fusion is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, any disputes between freelancers and employers regarding the quality, safety, or legality of the services provided.

10. Policy Updates 

10.1. Periodic Review and Modifications:

We may modify these Terms & Conditions periodically to reflect changes in our practices or service offerings. Updates will be communicated through our platform, with the revised date indicating the latest version. Your continued use of the Service following any changes signifies your acceptance of those changes.

10.2. User Acknowledgement:
By continuing to use Freelance Fusion after any updates to these Terms & Conditions have become effective, you acknowledge and agree to the revised terms. If you do not agree with the changes, you must discontinue using our services before the new terms take effect.
